Unless Congress have given appellate jurisdiction to this court, it will be conceded that none can exist.3 Under the Judiciary Act of 1789 assuredly no appeal lies, for none was given then or since.4 Until now, eighty years since the government was formed, no such thing as an appeal or writ of error in a case like this has been known.
